Terms of Service
These Terms govern your use of the Milk Drunk app, the milkdrunk.app website (including any blog or informational content we publish), and related services (collectively, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service. You may use the Service as a registered user or as a guest; some features (such as family sync and cross-device sync) require an account.
2. Medical disclaimer: please read
Milk Drunk is a general-wellness and informational tool. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. Information provided through the Service, including in the app (such as trends, insights, or reminders) and any articles or informational content we publish (for example on our blog), is for general informational purposes only, is not written or reviewed by a medical professional, and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your pediatrician or a qualified healthcare provider with questions about your child's health, feeding, or care, and seek emergency care when needed. Do not rely on Milk Drunk for any medical decision.
3. Your account
You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it up to date. Notify us of any unauthorized use.
4. Subscriptions and billing
Milk Drunk offers optional paid plans (e.g., Pro) sold as auto-renewing subscriptions through Apple's App Store. Payment is charged to your Apple ID. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; manage or cancel in your App Store account settings. Prices and plan details are shown in the app before purchase. Family sync is included at no charge for all users (see Section 5). Except where required by law, payments are non-refundable; refunds are handled by Apple under its policies.
5. Family sync
If you invite caregivers, you are responsible for who you invite and the access (role) you grant them. Caregivers can view and, depending on their role, edit your family's data. You can change roles or remove caregivers at any time.
6. Your content
You retain your rights to the data and content you add ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service and to provide it to the caregivers you authorize. You are responsible for Your Content and for having the rights to share it.
7. Acceptable use
Do not misuse the Service: no unlawful, infringing, harmful, or abusive activity; no attempts to breach security, access others' data without authorization, reverse engineer, or disrupt the Service; and no use that violates these Terms or applicable law.
8. Service availability and changes
We may modify, suspend, or discontinue features at any time. We aim for reliability but do not guarantee uninterrupted or error-free operation.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for security or legal reasons. Certain provisions survive termination (e.g., disclaimers, limitations of liability).
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. See also the medical disclaimer in Section 2.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GREENVINE CLOUD LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.
12. Indemnification
You agree to indemnify and hold Greenvine Cloud LLC harmless from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules.
14. Language
These Terms (and our Privacy Policy) are provided in English. The Service's interface may be available in other languages, and we may provide translations of these documents for convenience; in case of any conflict, the English version governs.
15. Changes to these Terms
We may update these Terms. Material changes will be reflected by an updated effective date and, where appropriate, in-app notice. Continued use after changes means you accept them.
